For those of you tracking the progress of the cert. petition in Stroud v. Blount, the Supreme Court will consider that petition at its conference this Friday, Oct. 29. The case was originally on the Court’s Oct. 15 calendar, but the Supreme Court’s docket shows the case has been re-distributed for the Oct. 29 conference. This petition and the pending petition in Shell Oil v. Hebble both raise issues regarding the proper method of calculating the ratio of punitive damages to “actual harm” for excessiveness purposes.
